We operate the ‘chargeprice’ web application and the “chargeprice” mobile application, which can be deployed in Android and iOS environments (referred to as ‘our applications’), on which we provide a platform for geolocating electric vehicle charging stations and comparing charging prices (referred to as ‘our platform’).
The purpose of these terms and conditions of use (referred to as ‘our T&Cs’) is to define the terms and conditions of use of our platform.
Our T&Cs are agreed between any user of our platform (referred to as ‘you’) and us, for any use of our platform.
In all cases where you wish to use our platform, our T&Cs apply.
Our T&Cs may be supplemented by our general subscription terms and conditions or our general terms and conditions of service (professionals), depending on your choice. Together, they express the entirety of our mutual obligations, to you and to us, concerning the terms and conditions of use of our platform, i.e. you cannot invoke any other document or agreement entered into prior to the conclusion of the contract, even if we have exchanged verbal or written communications beforehand.
Please read this document carefully. In order to use our platform, you must read and accept our Terms of Use without reservation, i.e. without modifications, additions or deletions.
We may modify our Terms of Use at any time. You will be notified of any changes via an announcement on our applications.
If you have registered on our platform and do not agree with the new version of our Terms of Use, you may delete your user account. You will then no longer be able to use our service. If you continue to use our platform even after the new version of our Terms of Use has come into effect, we will consider that you have accepted this version.
Our platform allows users to list and geolocate publicly accessible electric vehicle charging stations and compare charging prices per station. The list of countries for which listing is possible is available on our platform and is regularly updated.
Our platform is enriched by user contributions. If you notice that a price is inaccurate or you spot a charging station that is not listed on our platform, you can modify the corresponding data directly on our applications.
Authorisation to access our databases does not imply the transfer of any ownership rights over the data contained in these databases, which remain our sole property. It is prohibited to resell the data accessible on our platform to third parties without our authorisation.
All data accessed as part of a demonstration, test, evaluation, audit or in any other case where our GTC or GTCS do not apply is strictly confidential and may not be disclosed to third parties for any reason whatsoever.
IF YOU ARE A PROFESSIONAL: In the event of non-compliance with these prohibitions, you shall be liable for compensation in the amount of €25,000.00 (TWENTY-FIVE THOUSAND EUROS).
You are responsible for all costs associated with the purchase, installation, maintenance and connection of the various means of telecommunication necessary to access our application.
We are solely authorised to perform or arrange for corrective maintenance of our application. You may report any connection or usage anomalies to us.
We reserve the right to upgrade our application through updates. Some updates will be corrective in nature, while others will be evolutionary, in particular to improve our application or to keep it compliant with applicable regulations.
We inform you that access to our application may be temporarily interrupted in the event of maintenance or updates. You will be informed of this by a notification on the home page of our application.
Please note that the Internet network is subject to technical hazards that may affect the use of our application.
By using our platform, you must:
If you wish to modify data accessible on our platform, you must provide accurate data. The reliability and quality of our service also depend on your contributions.

If you are a professional and would like more detailed information about the data aggregated on our platform, you can contact us directly for information and a quote.
The data concerning the charging stations accessible on our platform is partly provided directly by users. We cannot guarantee that it is complete and accurate.
We cannot be held liable if the damage is entirely caused by your negligence or fault, by the unforeseeable and insurmountable actions of a third party, or in the event of force majeure. Force majeure refers to any external, unforeseeable and irresistible event within the meaning of Article 1218 of the Civil Code and as defined by case law.
Our application is a standardised IT solution that has not been developed for the needs of a particular user.
Nothing in this document authorises you to use the intellectual property assets present on our applications or in our documentation.
All text, images, logos and graphical interfaces on our applications and in all our documentation, as well as the IT component of our applications (software and its documentation), are protected by copyright worldwide. It is therefore prohibited for any person to copy, modify, distribute, transmit, broadcast, represent, reproduce, publish, license, transfer or exploit in any other way the aforementioned elements, as all such uses are likely to constitute an infringement.
It is prohibited to modify the source code of our applications in any way and for any reason, including to correct errors or anomalies, as maintenance is managed by us.

These General Terms and Conditions of Service for professionals (referred to as “our GTCS”) are intended to define the terms and conditions of our services.
Our GTCS are agreed between any professional, whether an individual or a legal entity, (referred to as “you”) and us, for any contract for the supply of our services.
In all cases where you wish to benefit from our services, our GTCS apply.
Our GTCS are supplemented by general terms of use, applicable whenever you use our applications. Together, these documents express the entirety of our mutual obligations, to you and to us, i.e. you cannot invoke any other document or agreement entered into prior to the conclusion of the contract, even if we have exchanged verbal or written communications beforehand.
Please read this document carefully. In order to benefit from our services, you must read and accept our GTCS without reservation, i.e. without modifications, additions or deletions. When you accept a quote issued by us, you are deemed to have read and accepted our GTCS.
We may modify our GTCS at any time. The services contract concluded between you and us is subject to the version of our GTCS in force at the time it is concluded. If you have taken out a subscription, you will be informed by email of any modification to an essential clause. If you do not agree with the new version of our GTCS, you may terminate the contract by registered letter with acknowledgement of receipt before the date on which the modification comes into effect. If you do not terminate the contract within the stated period, you will be deemed to have accepted the modification.
The following are considered essential clauses within the meaning of this article:
Our platform allows users to list and geolocate publicly accessible electric vehicle charging stations and compare charging prices per station. The list of countries for which listing is possible is available on our platform and is regularly updated.
You may request a quote from us at any time for one or more of our services. The exact terms of the service concerned are detailed in the quote.
The services are available as a one-off service or as a recurring service, in the case of a subscription.
We offer the following services to professionals:
We offer access to our aggregated databases via an interface.

In accordance with Article 23 of French Law No. 93-122 of 29 January 1993 on the prevention of corruption and transparency in economic life and public procedures, and the provisions of Decree No. 2017-159 of 9 February 2017 relating to digital advertising services, we will send you a report on a monthly basis.
In order to enable us to fulfil our legal obligations, if you have been mandated by a third party to subscribe to advertising space sales services, you must provide us with the identity and contact details of your principal. Failing this, we cannot be held liable for the consequences resulting from this failure.
You undertake to comply with applicable regulations, in particular those relating to prohibited commercial practices. We do not carry out any prior review of your advertising content and cannot be held liable in this respect. You guarantee us against any third-party claims relating to your advertising content published on our platform.
Authorisation to access our databases does not imply the transfer of any ownership rights over the data contained in these databases, which remain our sole property. It is prohibited to resell the data accessible on our platform to third parties without our authorisation. In the event of non-compliance with this prohibition, you shall be liable for compensation in the amount of €25,000.00 (TWENTY-FIVE THOUSAND EUROS).
It is possible to order our services in the form of a one-off, non-renewable service.
It is also possible to take out a subscription, for a fixed term set out in the quote, tacitly renewable at the end of the term for the same duration as the initial term, and then at each subsequent term for the same duration.
In this case, either you or we may decide not to renew the subscription, provided the other party is informed in writing before the scheduled renewal date, within the notice period set out in the quote.
In the event of non-performance of the contract by one of the parties, the other party may terminate it after a formal notice sent by registered letter with acknowledgement of receipt has remained wholly or partly unsuccessful after a period of 1 month.
By way of exception, we may terminate the contract without notice and without prior formal notice in the event of a breach of any of the following obligations on your part:
In the event of termination for fault, the aggrieved party may seek compensation for the damage caused by the defaulting party.
In order to benefit from our services, you must have full legal capacity to do so, i.e. you must have the authority to conclude a contract and bind the company you represent. If you are acting on behalf of a principal, your mandate must cover the conclusion of service contracts such as those covered herein.
You must be a professional within the meaning of the preliminary article of the French Consumer Code.
Creating a customer account is mandatory. You must provide us with accurate and complete information about yourself, update it as it changes, and correct it spontaneously if you notice any errors. We reserve the right to ask you for supporting documents at any time.
We reserve the right to refuse any request for services from you, even if you and we have already had a business relationship in the past.
The prices applicable to our services are those indicated in our quote. You can request a quote from us at any time by writing to contact@chargeprice.pro
Prices are expressed in euros excluding VAT and including VAT at the applicable rate. In the event of a change in the applicable VAT rate, the amended rate will apply automatically.

Subscription prices may change over time; you will be notified of any changes at least 1 week before they come into effect. The terms relating to modifications of our GTCS apply (see Article 3 “Modification of our GTCS”).
Only payments by bank transfer or direct debit are accepted. Any bank charges are your sole responsibility.
In the event of late payment, you automatically become liable for a fixed late-payment indemnity of €40.00 (FORTY EUROS) for recovery costs, in accordance with Articles L. 441-10 and D. 441-5 of the French Commercial Code. If the recovery costs incurred exceed this amount, we reserve the right to request additional compensation.
Data concerning charging stations (prices, mapping information, electric vehicle types) accessible on our platform is partly provided directly by users. We cannot guarantee that it is complete and accurate.
With regard to advertising space sales services, we act as a seller of digital advertising space and do not provide advertising consultancy, media planning or advertising space recommendation services. We cannot be held liable for the content and form of the promotional messages you edit and publish on our platform. You guarantee us against any third-party claims relating to these messages. We do not guarantee the success of your advertising campaign on our platform.
We cannot be held liable for any total or partial interruption of access to our platform if such interruption is caused by an event of force majeure (in particular, technical hazards inherent to the Internet).
We cannot be held liable for indirect damages suffered by you, including loss of earnings, loss of turnover, loss of profits, loss of business, loss of production, loss of opportunity or damage to image and reputation.
In any event, our liability shall be limited to (i) the total amount excluding VAT that you have actually paid us, in the case of a one-off service, and (ii) the total amount excluding VAT actually paid by you for the billing period in progress at the time of the complaint, in the case of a subscription.
10.1. You acknowledge that our computerised records constitute true copies within the meaning of Article 1379 of the French Civil Code and that they constitute proof of the communications, payments and transactions between you and us.
10.2. You agree to receive our invoices in electronic format.
10.3. You agree to conclude the contract electronically. Together, you and we acknowledge that the electronic signature has the same value as a handwritten signature.
10.4. Even if you or we do not report a breach by the other party of its contractual or legal obligations, this does not mean that you or we waive the right to report such a breach in the future.
10.5. If any clause of our GTCS is declared void, the other clauses of our GTCS shall not be voided as a result and shall remain applicable.
10.6. The French version of our GTCS is authoritative and prevails over any other version in a language other than French, particularly in the event of any contradiction or difference in interpretation. Any version of our GTCS provided in a language other than French is for informational purposes only.
10.7. For any complaints, you can contact us by post or email. If you do not receive a response from us within seven (7) days if you have contacted us by email, or one (1) month if you have contacted us by post, please consider that we have rejected your complaint.
The law applicable to our GTCS (and to any contract governed by them) is French law.
All disputes relating to the formation or performance of our GTCS and of any contract governed by them fall within the exclusive jurisdiction of the French courts and, more specifically, the Coutances Commercial Court, even in the event of multiple defendants, third-party proceedings, warranty claims or interim proceedings.

The consumer is entitled to the statutory guarantee of conformity in the event of a lack of conformity appearing during the entire duration of the subscription, from the date the digital content or digital service is supplied. During this period, the consumer is only required to establish the existence of the lack of conformity, not the date on which it appeared. The statutory guarantee of conformity entails an obligation to provide all updates necessary to maintain the conformity of the digital content or digital service throughout the duration of the subscription. The statutory guarantee of conformity entitles the consumer to have the digital content or digital service brought into conformity without undue delay following their request, free of charge and without major inconvenience to them. The consumer may obtain a price reduction while keeping the digital content or digital service, or may terminate the contract and obtain a full refund in exchange for giving up the digital content or digital service, if: 1° The professional refuses to bring the digital content or digital service into conformity; 2° Bringing the digital content or digital service into conformity is unjustifiably delayed; 3° Bringing the digital content or digital service into conformity cannot be done without cost to the consumer; 4° Bringing the digital content or digital service into conformity causes major inconvenience to the consumer; 5° The non-conformity of the digital content or digital service persists despite an unsuccessful attempt by the professional to bring it into conformity. The consumer is also entitled to a price reduction or termination of the contract where the lack of conformity is so serious that it justifies an immediate price reduction or termination. In that case, the consumer is not required to first request that the digital content or digital service be brought into conformity. Where the lack of conformity is minor, the consumer is only entitled to cancel the contract if the contract does not provide for the payment of a price. Any period of unavailability of the digital content or digital service for the purpose of bringing it into conformity suspends the guarantee for the remaining period, until the digital content or digital service is supplied again in a conforming state. These rights arise from the application of Articles L. 224-25-1 to L. 224-25-31 of the French Consumer Code. A professional who, in bad faith, obstructs the implementation of the statutory guarantee of conformity is liable to a civil fine of up to €300,000, which may be increased to 10% of average annual turnover (Article L. 242-18-1 of the French Consumer Code). The consumer also benefits from the statutory guarantee against hidden defects under Articles 1641 to 1649 of the French Civil Code, for a period of two years from the discovery of the defect. This guarantee entitles the consumer to a price reduction if they keep the digital content or digital service, or to a full refund in exchange for giving up the digital content or digital service. |
To invoke a statutory guarantee, you must contact us specifying the defect encountered while using our platform.
In order to keep our platform compliant, we will provide you with the updates necessary to maintain conformity.
Data concerning charging stations (prices, mapping information, electric vehicle types) accessible on our platform is partly provided directly by users. We cannot guarantee that it is complete and accurate.
We cannot be held liable if the damage is entirely caused by your negligence or fault, by the unforeseeable and insurmountable actions of a third party, or in the event of force majeure. Force majeure refers to any external, unforeseeable and irresistible event within the meaning of Article 1218 of the French Civil Code and as defined by case law.
Our application is a standardised IT solution that has not been developed for the needs of a particular user.
IF YOU ARE A PROFESSIONAL: We cannot be held liable for indirect damages suffered by you, including loss of earnings, loss of turnover, loss of profits, loss of business, loss of production, loss of opportunity or damage to image and reputation. In any event, our liability shall be limited to the total amount excluding VAT actually paid by you for the billing period in progress at the time of the complaint.
11.1. You agree to receive our invoices in electronic format.
11.2. You agree to conclude the contract electronically. Together, you and we acknowledge that the electronic signature has the same value as a handwritten signature.
11.3. Even if you or we do not report a breach by the other party of its contractual or legal obligations, this does not mean that you or we waive the right to report such a breach in the future.
11.4. The language of our GST is French. The French version is authoritative, particularly in the event of any difference in interpretation with a version translated into another language.
11.5. For any complaints, you can contact us by post or email. If you do not receive a response from us within seven (7) business days, please consider that we have rejected your complaint.
